In these Terms of Use ("Terms"), "Linkhome," "we," "us," or "our" refers to Linkhome Holdings Inc. and its affiliates.
By clicking a registration or account creation button, or by otherwise accessing or using Linkhome's websites, mobile applications, and services (collectively, the "Services"), you agree to be bound by these Terms of Use (as updated from time to time). If you do not agree to all of these Terms, you may not use or access the Services. These Terms constitute a binding legal agreement between you (also referred to as the "User") and Linkhome.
Please note that Linkhome's various service entities (such as Linkhome Realty, Linkhome Mortgage, Linkhome Escrow, etc.) are affiliated companies under common ownership. Because of these relationships, any referral by one Linkhome entity to another may provide the referred company or Linkhome with a financial or other benefit. You are not required to use any affiliate's services, but if you do, you will be subject to that affiliate's terms or agreements in addition to these general Terms.
Your use of the Services is also subject to our Privacy Policy (available on our website), which describes how we collect, use, and protect your personal information. By using the Services, you consent to the practices described in the Privacy Policy.
The Services are intended for use by adults. You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use our Services. By registering or using the Services, you represent and warrant that (a) you are 18 or older (and not under 13, in any case, as children under 13 are strictly not permitted to use the Services); (b) you have not been previously suspended or removed from any Linkhome service; and (c) your registration and use of the Services will comply with all applicable laws and regulations (including real estate laws and regulations). If you are using the Services on behalf of an organization or another person, you represent that you have authority to bind that entity to these Terms.
To access certain features, you may be required to create a user account. You agree to provide accurate, current, and complete information during registration and to update it as needed. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You may not share your account or transfer it to others, and you agree not to let any unauthorized person use your credentials. If you suspect any unauthorized use of your account, you must notify us immediately.
Unless expressly permitted by a separate written agreement with Linkhome, you may only use the Services for your own personal use and not on behalf of any third party. Real estate or mortgage professionals using Linkhome in their professional capacity must ensure they have any required client consents and comply with all applicable laws.
Subject to your compliance with these Terms, Linkhome grants you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the Services for your own personal, non-commercial purposes. This allows you to view properties, access content, and utilize our tools for buying, selling, or researching homes. All rights not expressly granted to you are reserved by Linkhome and its licensors. You agree not to use the Services for any unlawful or prohibited purpose.
You shall not engage in any of the following activities (and you agree not to enable or assist others to do so):
Illegal or Unauthorized Use. Use the Services for any purpose that violates any law or regulation, or to further any fraudulent, harmful, or illegal activity. You must comply with all applicable housing, real estate, and anti-discrimination laws (including the U.S. Fair Housing Act) when using the Services. You may not use the Services if such use is prohibited by law in your jurisdiction.
Intellectual Property Misuse. Copy, reproduce, modify, distribute, publicly display, or create derivative works from the Services or any content on the Services (including property listings, text, photos, or software) except as expressly permitted by Linkhome. You may not remove, obscure, or alter any copyright, trademark, or other proprietary rights notices on the Services. Using Linkhome's name, logos, or trademarks (including in meta tags or hidden text) without our prior written permission is prohibited.
Scraping and Data Extraction. Use any robot, spider, scraper, crawler, script, or other automated means to access, scrape, or collect data or content from the Services without Linkhome's express written permission. You also agree not to cache, frame, or deep-link to any portion of the Services without authorization.
Interference and Harmful Conduct. Interfere with or disrupt the proper functioning of the Services or any servers or networks connected to the Services. This includes not introducing viruses, worms, malware, or any other harmful code. You may not attempt to gain unauthorized access to any portion of the Services or any other accounts, computer systems, or networks connected to the Services through hacking, password mining, or any other means. You further agree not to use the Services in a manner that could damage, disable, or impair Linkhome's systems or security, or that harasses or interferes with any other person's use and enjoyment of the Services.
False Information and Impersonation. Submit false, misleading, or fraudulent information to Linkhome or through the Services. You shall not impersonate any person or entity, or falsely imply an affiliation with Linkhome or any other party.
Unauthorized Commercial Use. Use the Services to advertise or solicit the sale of any products or services not offered by Linkhome, or use the Services for any commercial purpose (such as marketing or data gathering) without our prior consent. You may not use the Services to perform real estate brokerage or rental agency services for others unless you are expressly authorized by Linkhome to do so (and have agreed to any separate terms required for such use). The Services are intended for residential real estate use; you agree not to use them for commercial real estate transactions (e.g., commercial properties or business rentals) unless explicitly permitted.
These examples of prohibited conduct are not exhaustive. Any violation of the above conditions is grounds for termination of your right to use or access the Services. Linkhome may investigate and take appropriate legal action against anyone who, in Linkhome's sole discretion, violates these Terms or engages in any conduct that is unlawful or harmful to Linkhome, our users, or others. We reserve the right to suspend or terminate your access to the Services and/or pursue legal remedies if you violate any of the above conditions (your permission to use the Services will be automatically revoked).
The Services, including all content, information, text, graphics, logos, images, software, and other materials contained therein, are the property of Linkhome or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. Except as expressly provided in these Terms, Linkhome and its licensors retain all rights, title, and interest in and to the Services and all Service content. You acknowledge that "Linkhome," Linkhome's logos, and all related names and marks are trademarks/service marks owned by Linkhome (or its affiliates or licensors), and these Terms do not grant you any license or right to use any Linkhome trademarks or logos for any purpose.
Linkhome grants you a limited license to access and use the Service content for your personal use as described above. However, you have no right to reproduce, distribute, publicly display, or prepare derivative works from any portion of the Services on any other website or platform without prior written permission. Any software that is made available to you is licensed, not sold, and is for your personal use in object code form only in accordance with these Terms. You may not reverse-engineer or decompile any of our software except to the limited extent allowed by law.
Except for the limited license expressly granted to you, Linkhome reserves all rights, title, and interest in and to the Services and their content. No rights are granted to you under these Terms by implication or estoppel. If you provide any feedback, comments, or suggestions to Linkhome regarding the Services ("Feedback"), you agree that Linkhome is free to use such Feedback for any purpose without attribution or compensation to you, in perpetuity. To the extent a license is required for Linkhome to use your Feedback, you hereby grant Linkhome an unrestricted, irrevocable, perpetual, worldwide, royalty-free license to use and exploit the Feedback in any manner.
The Services may include listings, images, data, or other content provided by third parties (such as Multiple Listing Services, property owners, or other users). Linkhome does not claim ownership of third-party listing images or descriptions, and all such materials are the property of their respective owners. Your use of any such third-party content may require permission from the owner and must comply with applicable law. Linkhome's provision of third-party content is for your convenience and does not imply endorsement. (See "Third-Party Links and Content" below for more information.)
Linkhome respects the intellectual property rights of others and expects users to do the same. If you believe that any content on our Services infringes your copyright, you (or your agent) may send us a written notice requesting that the content be removed or access to it be blocked. The notice should be addressed to our Designated Copyright Agent and include the information required by 17 U.S.C. § 512(c)(3) (Digital Millennium Copyright Act "DMCA" notice), such as:

We may begin investigating upon receiving an email notice, but we must receive a proper written DMCA notice (by email with an electronic signature or by mail) before we take action. If your content was removed due to a copyright notice and you believe it was misidentified or is not infringing, you may send us a counter-notification in accordance with 17 U.S.C. § 512(g). Once we receive a valid counter-notice, we may restore the material in question unless the original complainant informs us they have filed a court action. We will notify you if that happens. Repeat infringers' accounts may be terminated in appropriate circumstances.
Linkhome may allow users to post, upload, or submit content to the Services (for example, property listings by owners or agents, photos, profile information, reviews, comments, or other materials — collectively, "User Content"). You retain ownership of your User Content. However, by submitting or posting User Content on or through our Services, you grant Linkhome a worldwide, non-exclusive, transferable, sublicensable, fully paid-up, royalty-free license to use, reproduce, distribute, adapt, modify, publish, translate, publicly display and perform, and create derivative works from your User Content in any media now known or later developed, for the purposes of operating and providing the Services and for Linkhome's business purposes. This license to Linkhome survives any termination of these Terms, but with respect to content you remove from the Services, we will cease any further display of that content (other than retaining copies for archival/legal purposes). You also waive any moral rights or rights of attribution to the extent permitted by law, and you agree that Linkhome has no obligation to provide any compensation for your User Content.
In addition to displaying your User Content on the Linkhome platform, you agree that Linkhome may share your content with its affiliates, partners, and service providers as needed to provide and improve the Services (for example, sharing a home listing with a partner site or using your content in promotional materials). You acknowledge that Linkhome has the right (but not the obligation) to monitor, screen, remove, or edit User Content at any time at our sole discretion if we believe it violates these Terms or for any other reason. Linkhome is not responsible for storing or backing up your Content, and you are encouraged to keep copies of anything important. We do not guarantee that your User Content will appear on the Services, and we reserve the right to refuse to post or to remove any User Content for any reason.
You are solely responsible for all User Content that you upload or make available via the Services, and for the consequences of sharing such content. By providing any User Content, you represent and warrant that:
You agree that if any legal action arises from your User Content, you will bear full responsibility and defend and indemnify Linkhome as provided in the Indemnification section of these Terms.
The Services may include content provided by other users (for example, property descriptions written by sellers or comments in a community forum). Linkhome does not pre-screen or approve User Content, and you understand that when using the Services, you may encounter content that you find offensive, inaccurate, or otherwise objectionable. You assume all risk associated with viewing or using content posted by other users. Linkhome is not responsible or liable for any User Content posted by others, and we make no warranties or representations regarding such content. Nevertheless, if you become aware of any User Content that violates these Terms or is otherwise problematic, you may report it to us, and we may (but are not obligated to) investigate and take appropriate action at our discretion. You waive any legal or equitable rights or remedies you have against Linkhome arising from other users' conduct or content on our platform.
The Services may contain links to third-party websites or resources, or display content provided by third parties (including listings from third-party sources, data from Multiple Listing Services, advertisements, or services offered by others). These third-party sites and contents are provided for your convenience only. Linkhome does not endorse, adopt, or guarantee the accuracy or completeness of any information, products, or services provided by third parties on or through our Services. When you follow a link to an external site, you are subject to the terms and privacy policies of that site, which may differ from ours. You should review the applicable terms and policies of any third-party site you visit.
Linkhome is not responsible for: (i) the availability or accuracy of such external sites or resources; or (ii) any content, advertising, products, or materials on or available from third-party sites or resources. Any use of or reliance on any third-party content or materials is at your own risk. This includes information provided by other users, real estate professionals, multiple listing services, or advertisers. No Linkhome entity is responsible for errors or omissions in third-party content (for example, if a home listing provided by an MLS or a seller contains incorrect information, we do not warrant its accuracy). If you engage with a third-party (such as clicking an advertisement or employing a service provider you found through Linkhome), that interaction is solely between you and the third party. Linkhome is not a party to any transactions you may enter into with third parties, and we will not be liable for any loss or damage of any sort incurred as a result of such dealings.
Linkhome provides the Services on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Linkhome and its service providers and licensors disclaim all warranties, conditions, and representations of any kind, whether express, implied, or statutory. This includes, without limitation, any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties that may arise from course of dealing or usage of trade. We make no promises or guarantees that the Services will meet your requirements or expectations, or that the results of using the Services will be satisfactory or accurate.
The content and information available through the Services are for informational purposes only. Linkhome is not a law firm, financial institution, or tax advisor, and the Services are not intended to provide legal, financial, real estate, or other professional advice. You should independently verify any information obtained through the Services before making any decision (for example, confirm property details and consult appropriate professionals such as licensed real estate agents, inspectors, attorneys, or financial advisors). No information or content on the Services constitutes a guarantee or prediction of any outcome (such as a property's value or investment potential).
Linkhome does not guarantee that the Services will be uninterrupted, timely, secure, or error-free. We do not warrant that any defects will be corrected, or that the Services will be free of viruses or other harmful components. You assume all risk for any damage to your computer system or mobile device or loss of data that results from accessing or using the Services or downloading any content from the Services.
Linkhome does not control or vet third-party content for accuracy. While we endeavor to provide useful and up-to-date information, we make no warranty that any information (including listings, estimates, statistics, or professional recommendations) is complete, accurate, or reliable. All real estate listings and related data are subject to change. All information on the Services is provided "as is" without warranty of any kind. Use or reliance on any information obtained through the Services is at your own discretion and risk, and you are solely responsible for any actions you take based on such information.
You acknowledge that real estate transactions involve many factors beyond Linkhome's control. Linkhome makes no guarantees that using the Services will result in the purchase or sale of a property, obtaining financing, or any particular outcome. Any estimates or forecasts (such as home value estimates, market trends, or financing terms) are for informational purposes and are not guaranteed.
The Services may allow you to connect with real estate professionals (agents, lenders, etc.) or other service providers. Linkhome may facilitate contacts or display customer reviews, but we do not endorse or make warranties concerning these third parties. Any services they provide to you are governed by your agreement with them, not these Terms, and Linkhome disclaims liability for their acts or omissions.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not apply to you. In such cases, the scope and duration of any applicable warranty will be the minimum required by law.
To the maximum extent permitted by law, in no event will Linkhome or any of its affiliates, or their respective directors, officers, employees, or agents, be liable for any indirect, consequential, special, incidental, or punitive damages whatsoever. This includes, without limitation, damages for loss of profits, loss of data, loss of goodwill, business interruption, or any other intangible losses arising out of or related to your use of (or inability to use) the Services, even if Linkhome has been advised of the possibility of such damages. You specifically agree that Linkhome is not liable for:

In no event shall the aggregate liability of Linkhome and its affiliates to you for all claims arising out of or relating to your use of the Services or these Terms exceed the greater of: (a) the total amount (if any) you have paid to Linkhome for specific, paid use of the Services in the 12 months immediately prior to the event giving rise to the liability, or (b) $100 USD. If applicable law does not allow the limitation of liability for certain damages, the above limitation may not apply to you to that extent. However, in such cases, our liability will be limited to the fullest extent permitted by law.
You agree that the above disclaimers and limitations of liability reflect a reasonable and fair allocation of risk between you and Linkhome, and that this allocation is an essential part of the bargain between us. Linkhome would not be able to provide the Services on an economically feasible basis without such limitations. The limitations in this section will apply even if any limited remedy fails of its essential purpose.
Certain state laws (for example, laws in New Jersey or California) may not allow the exclusion or limitation of certain damages. If those laws apply to you, some of the exclusions or limitations above may not apply to you, and you may have additional rights. Nothing in these Terms is intended to limit your rights under those laws if applicable.
You agree to indemnify, defend, and hold harmless Linkhome, its parent company, affiliates, and subsidiaries, and each of their respective officers, directors, employees, agents, and representatives (the "Indemnified Parties"), from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees and costs) made by any third party that arise out of or relate to: (a) your use or misuse of the Services; (b) your violation of these Terms or of any law or regulation; (c) your User Content or any information you provide through the Services (including any allegation that such content infringes or misappropriates the intellectual property or other rights of a third party or has caused damage to a third party); or (d) your fraud, negligence, or willful misconduct.
You agree to cooperate fully with Linkhome in the defense of any claim. Linkhome reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (in which case you agree to cooperate with Linkhome in asserting any available defenses). This indemnity obligation will survive the termination of these Terms and your use of the Services.
Most user concerns can be resolved quickly and satisfactorily by contacting our customer support. You agree to try in good faith to resolve any dispute or claim with Linkhome informally for at least 60 days before initiating arbitration or court proceedings. To begin the informal dispute process, you must send a written notice to Linkhome (at the address in the Notices section below) describing your dispute and your desired resolution. If we are unable to resolve the dispute informally within 60 days from our receipt of the notice, either party may then proceed to seek formal resolution as outlined below.
By agreeing to these Terms, you and Linkhome each agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services will be resolved through final and binding arbitration rather than in court, except for the specific exceptions below. This means that you and Linkhome are waiving the right to a trial by jury and to participate in a class action or class arbitration. This arbitration agreement is governed by the U.S. Federal Arbitration Act and shall apply to any claims that arise or are asserted after termination of these Terms.
This agreement to arbitrate is intended to be broadly interpreted. It includes, for example, disputes based on contract, tort, consumer protection laws, fraud, competition laws, and any other legal theory. However, either you or Linkhome may choose to bring an individual action in a U.S. small claims court (if the claim qualifies) in lieu of arbitration. In addition, disputes relating to intellectual property rights or claims for injunctive relief to stop unauthorized use of the Services or infringement of intellectual property may be brought in court. All other disputes will be resolved by binding arbitration on an individual basis.
The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (the "AAA Rules") in effect at the time the dispute is filed, and as modified by this section. You can find the AAA Rules on the AAA website (www.adr.org) or by calling the AAA. The arbitration will be conducted by a single, neutral arbitrator. If the parties cannot agree on an arbitrator, the AAA will appoint one. The location of the arbitration shall be in the county of your residence, or another location mutually agreeable to the parties, or via remote methods (such as video conference) as appropriate.
Payment of all filing, administration, and arbitrator fees will be governed by the AAA Rules. In certain cases, for claims under a certain dollar amount, Linkhome will reimburse your AAA filing fee or pay the filing fee directly, as provided in the AAA Rules or as required by law. The arbitrator may award any relief on an individual basis that a court of competent jurisdiction could award, including compensatory, statutory, and injunctive relief, but the arbitrator may not award relief benefiting anyone other than the individual party seeking relief. The arbitrator's award shall include a written statement of the disposition of each claim and the reasoning on which the award is based. The arbitration proceedings and outcome shall remain confidential, except as may be necessary to enter judgment on the award or as required by law.
You and Linkhome agree that all claims will be arbitrated only on an individual basis and not on a class, consolidated, or representative basis. The arbitrator shall have no authority to consider or resolve any claim or issue any relief on any basis other than an individual case. The arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated, and may not otherwise preside over any form of a representative or class proceeding. If this class action waiver is found unenforceable, then the entirety of the arbitration agreement shall be null and void (but the rest of these Terms will remain in effect).
You have the right to opt out of the agreement to arbitrate if you notify Linkhome within 30 days of the first acceptance of these Terms. To opt out, you must send a written notice of your decision to opt out to Linkhome's Legal Department, either by email to info@linkhome.com or by mail to the address listed below, with a subject line "Arbitration Opt-Out." Your opt-out notice must include your name, address, the email address associated with your Linkhome account (if any), and an unequivocal statement that you want to opt out of this arbitration agreement. The notice must be postmarked or emailed within 30 days of the date you first agree to these Terms (for example, the date you first create an account or use our Services after these Terms take effect); otherwise you will be bound to arbitrate disputes under these Terms. If you opt out of arbitration, you will not be subject to this arbitration agreement, but the other parts of these Terms will still apply to you. Opting out of this arbitration agreement will not negatively affect any other rights or benefits you have under these Terms.
These Terms of Use, and any dispute between you and Linkhome (whether subject to arbitration or not), are governed by the laws of the State of California, U.S.A., and, where applicable, the federal laws of the United States, without regard to conflict of law principles. This choice of law applies even to claims that may arise under statutes of other jurisdictions.
Subject to the arbitration agreement above, if any dispute arises between us that is not resolved by arbitration (either because you validly opt out of arbitration or a court determines that the arbitration agreement is not enforceable or does not apply to a particular claim), such dispute shall be resolved exclusively in the state or federal courts located in Orange County, California. Both you and Linkhome consent to personal jurisdiction in those courts and waive any objection to the convenience or fairness of proceeding in such courts. This means any such dispute will be litigated only in courts located in California, and you agree not to argue that those are an improper or inconvenient venue.
To the extent permitted by law, any claim or cause of action arising out of or relating to the Services or these Terms must be filed within one (1) year after such claim arose; otherwise, the claim is permanently barred. (This limitations period does not apply to causes of action under statutes that impose a longer mandatory period, or to any claim for indemnification.)
You may cancel or delete your Linkhome account at any time through the account settings interface or by contacting our customer support. Termination of your account will be effective once processed, though historical data or content may persist in backups or where required by law. Keep in mind that even after you delete your account, these Terms (and any subsequent versions of them) will still apply to your past use of the Services.
Linkhome reserves the right to suspend or terminate your account or access to the Services at any time, with or without notice, for any reason or no reason, at our sole discretion. Without limiting the foregoing, we may suspend or terminate your use if we believe: (i) you have violated these Terms or any applicable law; (ii) you pose a security, legal, or reputational risk to Linkhome or any other users; or (iii) our provision of the Services to you is no longer commercially viable. We may also discontinue any part of the Services, or the Services in their entirety, at any time and without notice as we see fit. Linkhome shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Services or any part thereof.
Upon any termination of these Terms or your account, the rights and licenses granted to you will immediately end and you must cease all use of the Services. Any provisions of these Terms which by their nature should survive termination (such as ownership provisions, warranty disclaimers, limitations of liability, dispute resolution, and indemnification) shall survive and continue to apply. If your account is terminated or suspended due to a breach of these Terms, you will not create a new account without our express permission.
Linkhome may update or revise these Terms of Use from time to time. We will notify users of material changes by posting the updated Terms on our website (with a new "Effective Date" at the top) or through other communications. It is important that you review the Terms whenever we update them. If you continue to use the Services after the Terms have been updated, you are agreeing to the revised Terms. If you do not agree to a change, you must stop using the Services and (if applicable) terminate your account. We encourage you to review these Terms periodically to ensure you understand the terms and conditions that apply to your use of the Services.
These Terms (including any additional terms or agreements incorporated by reference, such as our Privacy Policy or any product-specific terms you agree to) constitute the entire agreement between you and Linkhome regarding the Services, and supersede all prior and contemporaneous understandings, agreements, representations, or warranties, both written and oral, regarding the Services.
No failure or delay by Linkhome in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power, or privilege preclude any other or further exercise of that or any other right, power, or privilege. Our failure to enforce any provision of these Terms will not be deemed a waiver of our right to enforce it later.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified so as to reflect the parties' intention to the maximum extent enforceable, or if not possible, deemed severed from these Terms, and the remaining provisions will continue in full force and effect.
You may not assign or transfer these Terms (in whole or in part) or any rights or obligations hereunder to any other party without Linkhome's prior written consent. Any attempt to do so without consent will be null and void. Linkhome may freely assign or transfer these Terms or any of its rights or obligations, in whole or in part, to any affiliate or in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law or otherwise, and these Terms shall bind and inure to the benefit of Linkhome's successors and assigns.
These Terms are intended for the benefit of you and Linkhome, and no third party shall have any rights to enforce any terms hereof, except as expressly provided (for example, indemnified parties under the Indemnification section, or as required by law).
You consent to receive communications from Linkhome electronically, such as emails, texts, in-app notifications, or postings on the site. You agree that all notices, agreements, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. For details on how we communicate, please see our Privacy Policy and any communication preferences in your account settings.
